Man who drunkenly crashed vehicle with kids inside gets probation

IDAHO FALLS — A 25-year-man will serve probation after he drove drunk with three kids in his vehicle and hit a pole.

District Judge Joel Tingey sentenced Zachary D. Bradley, of Lewisville, to a prison term of one to four years Monday, but suspended that sentence and ordered that he serve three years on probation.

In March, Bradley was driving with three children in his Chevrolet Trailblazer and went through an Idaho Falls intersection at a high speed just before he struck a pole on on Snake River Parkway, witnesses told police.

As part of a plea agreement, Bradley pleaded guilty in June to felony injury to a child and misdemeanor DUI, and prosecutors motioned to dismiss the two felony injury to a child charges.

The children in the vehicle included two 15‐year‐olds and one 5‐year‐old child. Bradley was transported to the hospital, and the passengers were checked out by paramedics.

Police said the passengers were wearing their seat belts.

Former elementary principal pleads guilty to stealing money from school

The following is a news release from the U.S. Attorney’s Office for the District of Idaho on Tuesday.

POCATELLO – Brenda Honena, 52, of Blackfoot pleaded guilty today in United States District Court to the theft of money from the Fort Hall Elementary School in 2012, U.S. Attorney Wendy J. Olson announced.

Honena was indicted by the federal grand jury in Pocatello on February 23, 2016.

In 2012, officials in the Blackfoot School District #55 discovered that certain suppliers for fundraisers held at the Fort Hall Elementary School had not been paid. An investigation revealed that $9,463.51 of money from fundraisers held at the school was missing. Honena was then employed as the principal at the school. She initially denied taking the money but in a later interview with special agents from the Federal Bureau of Investigation, she admitted taking the money and being responsible for the missing $9,463.51. Honena admitted she spent the money for her personal use and did so without authorization.

The federal court has jurisdiction over this case because the Blackfoot School District #55 receives federal funding for its operations. The charge of theft from an organization receiving federal funds is punishable by up to ten years in prison, up to three years of supervised release, and a fine of up to $250,000.

Honena is scheduled to be sentenced on Nov. 8, 2016, before Chief U.S. District Judge B. Lynn Winmill at the federal courthouse in Pocatello.

The case was investigated by the Federal Bureau of Investigation and the Fort Hall Police Department.

Subway employee arrested, accused of drugging Utah police officer

LAYTON, Utah (KUTV) — A lunch-hour trip to Subway ended with a Layton City police officer being treated for ingesting illegal drugs after a restaurant employee spiked his drink, Layton detectives tell KUTV.

Tanis Ukena, 18, is in custody at the Davis County jail on suspicion of Surreptitious Administering of Poisonous Substance. According to a narrative by Layton Police Detective Kelly Rushton, Ukena was working at a Subway when a police sergeant in a marked police cruiser ordered a sandwich and drink at the drive-thru.

Ukena prepared the sergeant’s drink and was seen with something in his hand as he stepped out of view of a surveillance camera for an extended period of time before returning and handing the officer the drink, according to Layton Police.

Shortly after leaving the drive-thru, the officer began to feel sick and returned to the Layton police headquarters where he sought help from other officers.

Detectives were contacted and tested the Subway drink. An initial result from an ion scanner analysis showed the drink was spiked with meth and THC, Detective Rushton’s narrative said.

The officer was treated by paramedics and detectives tracked down Ukena. According to Detective Rushton, Ukena did not admit to anything and was not cooperative with their investigation
Police, however, said the surveillance video showed Ukena bent over the officer’s drink and they arrested him.

The officer was hospitalized but has since been released. He has not yet returned to duty.

Ukena is being held on $10,000 bail.

Apparent overdose kills alleged Walgreens pharmacy robber

AMMON – A 34-year-old Ammon man alleged to have robbed a local pharmacy was found dead by family members late last week.

Kyle R. Gneiting was discovered by relatives Saturday, according to Bonneville County Sheriff’s Office spokesman Sgt. Bryan Lovell. Gneiting was alone in his home and was found with empty alcohol containers and controlled substance containers containing a “white powdery substance”.

Authorities say it appears to have been a drug overdose, but the official cause of death will not be determined until toxicology reports are complete.

Gneiting was arrested in April and charged in connection with a robbery that occurred at the Ammon Walgreens on 17th Street last October. Gneiting later faced another felony armed robbery charge in relation to a Walgreens robbery that took place March 31.

In addition to the robbery charge, Gneiting faced a felony weapon enhancement charge in relation to the March robbery.

In March, Gneiting posted a $150,000 bond and later in the month pleaded not guilty to the charges. Gneiting was due to stand trial in November.

According to his obituary, he served in the Idaho National Guard, was in Iraq from 2004 to 2005 and received various military honors.

“Kyle returned home a disabled veteran with blown discs in his back and neck, PTSD and an immune disorder. He had a hard time fighting off infections and has been ill a lot,” his obituary reads.

His obituary gives his cause of death as a heart attack.

Sword-wielding man allegedly chases and attacks brother in Idaho Falls

IDAHO FALLS — A 29-year-old man brought a sword into a family dispute last week, say police.

Daniel Paulsen, of Idaho Falls, chased his brother with a sword, and when he was unable to catch up, he threw a hunting knife at him, according to court documents.

Paulsen’s brother arrived at Paulsen’s home on the 300 block of Wilson Drive in the evening of Aug. 4 to do renovation work.

Courts records indicate Paulsen had punched several holes in the walls of his own home and damaged it by throwing knives at it.

When the brother arrived, Paulsen left the residence with a knife in his hand and a sword sheathed to his back, according to reports.

When his brother approached, Paulsen began to draw the sword, at which point the brother ran away. It’s unclear why Paulsen allegedly pulled a sword on his brother.

While he was chasing after his brother, Paulsen threw a knife at him, according to court documents. The knife fell short, bounced off the road and struck the brother in the ankle.

The brother told police he feared for his life.

When police arrived to speak with Paulsen, he had multiple sword sheaths on his belt. Court documents say Paulsen told police he was protecting his home.

Paulsen was arrested and booked into the Bonneville County Jail on a felony aggravated battery by use of a deadly weapon charge. As of Wednesday, he was being held on a $5,000 bond.

A preliminary hearing is scheduled for Aug. 17.

Woman who wrote checks to herself pleads guilty to reduced charge

IDAHO FALLS – A woman who stole thousands of dollars from her employer by writing checks to herself pleaded guilty Wednesday to committing a felony computer crime.

Ariel C. Murdock, 25, of Idaho Falls, pleaded guilty to the charge before District Judge Dane Watkins Jr. as part of a plea agreement.

She stole money from her employer, Wolverine Canyon Construction, by forging multiple checks to herself between October and December 2015 totaling between $46,000 to $60,000, Idaho Falls police said.

Court documents show Murdock was hired to help with payroll, and she was getting paid $10 per hour working part time, but within a few months, she had cashed over $20,000 in checks.

The original charges of felony grand theft and forgery against Murdock will be dropped if the terms of the plea agreement are met. As part of the agreement, prosecutors will recommend that Murdock serve probation as long as she shows actual intentions to successfully complete problem-solving court, according to the Bonneville County Prosecutor’s Office.

Sentencing is set for Oct. 11.

As the victim, Wolverine Canyon Construction has requested that no restitution be set. Court documents show that Murdock’s mother, Debra Jones, is a partial owner of Wolverine Canyon Construction.

The co-owner of the company, Ron Kruger, is suing Jones for using company funds for non-company purposes “in an amount currently believed to be in excess of $400,000,” according to court documents.

The civil complaint shows Jones owns 51 percent of Wolverine Canyon Construction, and the other 49 percent is held by Kruger.

According to the lawsuit, filed in early December, the two had a falling out in September 2015 stemming from Jones’ use of company funds for non-company purposes. Jones is also believed to have breached the operating agreement by misappropriating profits of the company and failing to account to Kruger, despite his request for her to do so.

Court documents show Kruger has requested that Wolverine Canyon Construction be dissolved and sold as an ongoing business, if possible, or all assets be sold and the resulting amount obtained be distributed to the parties, with adjustments made for Jones’ misappropriation of the company.

Man involved in police stand-off charged with felony

IDAHO FALLS — An eleven-time convicted felon is facing an additional felony charge after barricading himself inside a home Saturday.

Rory D. Neddo, 27, has been charged with felony possession of a firearm following the nearly seven-hour stand-off.

The Idaho Falls Police Department attempted to serve warrants to Neddo at a home on the 500 block of 10th Street around 9:30 a.m. Due to threats of violence, officials made phone contact with the suspect and he refused to leave the house.

Dozens of officers surrounded the home and police say Neddo threatened violence throughout the day. At one point, a single gunshot was heard from within the residence.

Police rammed the front door around 4:15 p.m. and detonated gas inside the house. Neddo was peacefully arrested.

Neddo was wanted on an Idaho Department of Correction parole violation warrant, two Idaho Falls warrants for domestic violence and felony possession of a firearm.

He remains in the Bonneville County Jail on $50,000 bond for the new felony weapons charge.

DRIGGS — The case against a man charged with killing a pregnant Driggs woman will move forward to district court. Judge Jason Walker ruled in a preliminary hearing on Friday there was enough evidence for two counts of felony murder charges against Erik Ohlson, 39, of Jackson.

Ohlson faces one murder charge for the shooting death of Jennifer Nalley, 39, of Driggs. The second count stems from the death of Nalley’s unborn child.

Ohlson was arrested for a DUI after crashing his vehicle into a utility pole. While he was in custody, he told investigators he shot Nalley after coming to her home in Driggs. He said he was in a relationship with Nalley and was aware that she was pregnant.

He allegedly shot Nalley multiple times on July 5.

In a lengthy hearing, the prosecution laid out the evidence in the case, including testimony from a firearms expert and information from the autopsy.

That testimony allowed deputy prosecutor Christopher Lundberg to say that Ohlson had to pull the trigger of his 45 caliber Glock pistol eight separate times to account for the gunshots in Nalley’s back.

Other evidence included text messages between Ohlson and a mutual friend of his and Nalley’s, where he mentioned wanting to kill Nalley several times.

The friend said she didn’t interpret the messages as threats and tried to talk Ohlson down. The text conversations included the following phrase from the Fourth of July, the day before the murder.

“I was literally tying my shoelaces when you texted. I was heading to Driggs to commit a murder, Glock loaded with hollow points, plans of killing her and killing myself,” Ohlson wrote. “I’m not being dramatic.”

Ohlson sent another message claiming that he was in for the night and was not planning on going anywhere.

His defense attorney, Jim Archibald of Idaho Falls, raised some issues with the evidence being introduced, but nothing that prevented the exhibits from being admitted for the purposes of a preliminary hearing.

One regarded that when the Idaho State Police interviewed him, Ohlson indicated that he wanted a lawyer but detectives continued to speak to him. The prosecution argued that Ohlson said that he may want a lawyer and the detectives were clarifying his statement. Ohlson then waived his right to an attorney before the interview continued.

“He asked for a lawyer, I think the inquiries should stop instead of the officer trying to be his buddy and trying to get him to talk some more,” Archibald said.

Currently the case is set to go before the district court on Sept. 6.

Disturbance call leads officers to stolen golf cart

IDAHO FALLS — A 27‐year‐old man has been arrested after police say he was in possession of a stolen golf cart.

The stolen cart and a set of golf clubs were rented from the Pinecrest Golf Course around 1 p.m. on Saturday, and neither were returned.

The golf course reported the theft to police Sunday afternoon.

Later that day, the Bonneville County Sheriff’s Officer responded to a disturbance call on the 3500 block of East 17th Street in Ammon. While investigating the disturbance, deputies discovered the stolen golf cart and one of the clubs in the possession Trevor K. Salmon of Idaho Falls.

Salmon was arrested and booked into the Bonneville County Jail for grand theft by possession, a felony, in connection to the stolen golf cart.

On Monday, Salmon’s bail was set at $15,000.

Spokane homicide suspect arrested in Blackfoot

BLACKFOOT -– Authorities have arrested a Pocatello man suspected of killing a woman and her brother in a Washington home Monday.

Bingham County Sheriff Craig Rowland confirmed that Gilberto Delgado, 44, was arrested this afternoon.

Delgado is a convicted felon from the Pocatello area with an extensive criminal background and listed as a fugitive with the Idaho Department of Correction.

On Monday, around 8:45 a.m., Spokane Valley Police received a 911 call from a young boy who said his mother and uncle had been killed. Deputies responded to a home on the 600 block of South Michigan in Spokane Valley and found a woman and man who had been shot to death.

Delgado is described as a Hispanic male, 6 feet tall, 155 pounds, with brown eyes and a shaved head. He has the name “Brenda” tattooed on one of his forearms.

He is possibly driving a newer black Dodge Dart with tinted windows and red pin striping. Investigators believe he could be on his way to the Pocatello area.

Delgado is believed to be armed and considered dangerous. According to the Idaho Department of Correction, Delgado has a lengthy criminal history in Power County that includes charges of injury to a child, escape, grand theft and aggravated assault. He was sentenced to prison until 2019 but released on parole in October 2015.

Double murder suspect arrested in Blackfoot

BLACKFOOT — Authorities have confirmed a man accused of murdering two people in Spokane Valley has been arrested.

The Idaho State Police and the United States Marshals Service arrested Gilberto Delgado, 44, just after noon today in a parking lot on Parkway Drive in Blackfoot.

ISP detectives received information that Delgado was believed to be traveling southbound on I-15 this morning. Detectives located a man driving a black Dodge Dart that matched Delgado’s description and the vehicle was displaying stolen license plates. Delgado was followed to a parking lot on Parkway in Blackfoot and he was taken into custody at 12:02 p.m. without incident.

“They contacted him in a parking lot and Delgado was taken into custody without incident,” wrote Spokane Valley Police Department in a press release.

The Bingham County Sheriff’s Office says he was captured in the parking lot of a Taco Bell. ISP officials said he was taken into custody at 12:02 p.m.

Authorities had been searching for Delgado, a 44-year-old convicted felon from the Pocatello area with an extensive criminal background.

Boise Man Pleads Guilty to Sex Trafficking of Children

BOISE — Michael Wayne Wade, 30, of Boise pleaded guilty today in United States District Court to sex trafficking of children, U.S. Attorney Wendy J. Olson announced.

According to the plea agreement, agents with the Idaho Department of Probation and Parole arrested Wade for a felony probation violation in July of 2014. A Nokia Lumina cell phone was seized from Wade and examined by a detective with the Boise Police Department. The cell phone contained texts with a minor that included images of the minor, including one that was sexually explicit. The detective conducted open-source internet searches on Backpage.com and discovered that the images of the minor on Wade’s phone had been posted in an ad for “escort services” in Boise in July and November of 2014. The postings were made using a Backpage.com account for another individual, J.K.

J.K. was arrested by the Boise Police Department in December of 2014, and admitted she worked as a prostitute in Boise, and that Wade was the “boss” who “pimped her.” She admitted Wade asked her to use the minor for a two-girl “date,” which she refused. She admitted posting the minor as an escort on Backpage.com, using the images sent to her by Wade. She further admitted that Wade spoke to her about taking the minor “under her wing,” assisting her in “escorting,” and ensuring that she was “working.” J.K. admitted that she took the minor on at least two “dates” where the minor engaged in commercial sex acts, and that she received money from the minor in exchange for posting the ad and transporting her.

The minor was interviewed and admitted that she participated in a prostitution enterprise with Wade and J.K. She stated she sent the images of herself to Wade for the purpose of being posted on Backpage.com as an escort. The minor stated that J.K. posted her images on Backpage.com, and drove her on at least two “calls” where she engaged in a commercial sex act when she was sixteen years old.

Further investigation by the Boise Police Department and the FBI revealed recorded phone calls and text messages from Wade to J.K. and the minor. The text messages revealed that Wade knew the minor was sixteen years old, that he told her she would be a “star by the time I’m done with you,” encouraged her to “hustle all day,” and told her that J.K. would teach her “the tricks of the trade” and “how to hustle.” Wade also told the minor that she had “mad potential,” could “turn tricks,” and that J.K. would “buy you a room” and “have you got to work this weekend.” Wade then told J.K. that the minor was “all open” and “down to work for the team.”

“This defendant callously victimized a minor, commercially exploiting her for the sexual gratification of others and for his personal profit,” said Olson. “This conviction demonstrates that this office and its law enforcement partners in Idaho are unwavering in our commitment to seek justice on behalf of vulnerable victims and to hold sex traffickers accountable.”

Sentencing is set for November 10, 2016, before Senior U.S. District Judge Edward J. Lodge. Sex trafficking of children is punishable by not less than 10 years’ imprisonment and up to life, a $250,000 fine, a term of supervised release of not less than five years and up to life.

The case was investigated by the Boise Police Department, the FBI, and the Idaho Department of Probation and Parole, and was prosecuted with assistance from the Ada County Prosecutor’s Office. The case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute individuals who sexually exploit children, and to identify and rescue victims. Teton County, Idaho, to seek death penalty in double murder

DRIGGS — The Teton County, Idaho, Prosecutor’s office confirmed that it will be seeking the death penalty for Erik Ohlson, 39, of Jackson, Wyoming.

Ohlson will be arraigned in an Idaho District Court on Sept. 6 with two charges of first degree murder.

Ohlson faces one murder charge for the shooting death of Jennifer Nalley, 39, of Driggs. The second count stems from the death of Nalley’s unborn child.

Ohlson was arrested for a DUI after crashing his vehicle into a utility pole. While he was in custody, he told investigators he shot Nalley after coming to her home in Driggs. He said he was in a relationship with Nalley and was aware that she was pregnant.

There, he will have the opportunity to plead guilty or not guilty.

County Prosecutor Kathy Spitzer confirmed that prosecutors would declare their intent to seek the death penalty before then.

Cases involving the death penalty can become very expensive.

“The cost of a capital case can vary widely depending on the specifics of the case and the speed at which the prosecution and defense come to a settlement,” said Idaho Association of Counties Associate General Counsel Dan Blocksom. “The range can be anywhere from about $10,000 to $500,000…”

By seeking the death penalty, the county is triggering the Capital Crimes Defense Fund, CCDF, which is designed to “ease the burden of the cost of trials for death penalty cases.”

The fund, which counties pay into on a per capita basis, is governed by the Idaho Association of Counties, IAC.

“Counties don’t have to pay into the fund, but if they don’t, then the State Appellate Public Defender will not handle the defense for their appeals,” said Blocksom.

The CCDF works kind of like an insurance policy, with a deductible of $10,000 and an annual “premium” based on county population.

According to Blocksom, Teton County’s dues amount from 2007 to 2016 has been $3,095 per year.

Once the county pays the deductible, “the CCDF will pay the costs for the second attorney (required for death penalty cases) and all other related trial costs including but not limited to preparation, investigation, forensics, mitigation, etc.”

These requirements can get very expensive.

“Even if the capital defense kicks in, some counties can almost go broke over prosecuting something like this,” said Blocksom.

This is in part because the CCDF pays for only one of the defendant’s attorneys and does not pay any of the prosecution’s bills.

“IAC has been primarily concerned about ensuring the 6th Amendment right to counsel for indigent defendants, and thus has been urging the Idaho Legislature to provide state funding to the counties to protect this right,” said Blocksom. “Prosecution, on the other hand, is not a constitutional issue in the same way that public defense is, so IAC’s handling of this issue is only indirectly through its assistance of the CCDF board’s discussions.”

Just the reimbursable parts of a capital case can reach the hundreds of thousands.

The CCDF paid more than $400,000 in claims to Latah County’s defense of Dale Shackelford, who killed his ex-wife and her boyfriend and then set fire to the building where their bodies were found.

Shoshone County Clerk Peggy White is dealing with the payments for one such capital case, where a 26-year-old woman was charged with murdering a 22-month-old child. The case is still ongoing, but no longer involves the death penalty.

For White, paying for the case has proven a challenge.

“It’s devastating to have a murder case,” said White. “So far, I’ve got a ton of bills. Approximately $168,000 thus far… It’s a big deal to us.”

Shoshone County, which is 76 percent public land and has a population of about 12,600, had to pay for trial costs upfront by forming a trust account, which the Defense Fund reimburses.

To be reimbursed, the expenses have to first be approved by the CCDF board, made up of representative county commissioners from each state district.

Furthermore, according to the CCDF’s guidelines, “if a case is converted from a capital case to a non-capital case prior to trial, the CCDF shall pay only those amounts incurred prior to conversion to a non-capital case.”

Prosecutors can remove the intent to have capital punishment at any time.

Ohlson’s defense has not returned a request for comment.

Man arrested after woman witnesses him breaking into her home

IDAHO FALLS — A 28‐year‐old man is in jail after he allegedly broke into a home and stole jewelry.

Idaho Falls Police received a call Tuesday in reference to a burglary in progress just after 4:00 p.m. at a home in the 1600 block of South Boulevard.

The homeowner told police she was driving toward her home and notice a man knocking on her door. When no one answered the man went to a window air conditioning unit, pulled it out and entered the home.

Police arrived on scene while the man was still within the home and positioned themselves outside the house. When the suspect left the home, police apprehended him.

The man was identified as Aaron Stewart, of Idaho Falls. Police say Stewart was found in possession of cash and jewelry that was stolen from the home.

Stewart was booked into the Bonneville County Jail on a felony burglary charge and is held without bond until he makes his first court appearance this afternoon.

Video shows thief during Guns N Gear burglary

IDAHO FALLS — Detectives are asking for the public’s help in identifying the person who burglarized Guns N Gear on Tuesday morning.

Police responded to the business at 1315 S. Utah Ave. around 2:50 a.m. for a burglar alarm. When they arrived, officers found the thief had damaged the roll-up door to break into the business. He stole 16 handguns.

He is believed to also be connected to other reported burglaries within Idaho Falls and Bonneville County.

Guns N Gear general manager Andy Giddings says “thousands and thousands” of dollars worth of handguns were taken. Police say the suspect stole 16 handguns.

Rigby Police arrest local homeless man for indecent exposure

The following is a news release from the Rigby Police Department.

RIGBY — A homeless man was arrested in Jefferson County Tuesday on a warrant for misdemeanor indecent exposure.

Tyrone Caldwell was taken into custody without incident and transported to the Jefferson County Jail, where he was charged with the offense, according to a Rigby Police Department news release.

Earlier this month, officers received multiple complaints that Tyrone had been exposing himself on both public and private property. The victims included multiple adults, who wish to remain anonymous, and a juvenile female.

After obtaining a positive identification by a number of the complainants, an affidavit was filed with the local magistrate, and a warrant for Tyrone’s arrest was issued.

At the time of his arrest, Tyrone was found to be in possession of a check book which belonged to an Island park resident, that has no relation to Tyrone, and reported to officers that his check book had been missing for some time.

Tyrone was also charged with unlawful possession of a bank account number.

UPDATE:

Capt. Randy Lewis of the Rexburg Police Department says Rexburg police were notified by Madison County Dispatch around 2:30 p.m. Thursday that law enforcement officers were pursuing a vehicle from Fremont County that was headed into town.

Rexburg police were ready when the suspect entered city limits. Lewis said he was going 50 mph on side streets. Police had him cornered at JB’s Restaurant on West Main Street, but he got away and damaged a shed.

Six cars were damaged when the crash ended on Main and Center Street, including the suspect’s. He had a four-wheeler in the back.

“We believe he is the man wanted in connection with the Guns N Gear burglary (in Idaho Falls),” Lewis told EastIdahoNews.com.

Idaho Falls police have not confirmed the man’s connection with the burglary, which happened Tuesday.

The suspect, whose name has not yet been released, is being treated at Madison Memorial Hospital and will be booked into the Madison County Jail, Lewis said.

ORIGINAL STORY:

REXBURG — A man has been taken into custody after a high-speed chase that ended on the corner of Center Street and Main Street in Rexburg.

The accident involved a white truck carrying an ATV and at least two other vehicles.

Multiple law enforcement sources say the man driving the white truck matches the description of the man who burglarized Guns N Gear in Idaho Falls on Tuesday morning. When he arrested, witnesses say the man was wearing a black wig and was dressed as a woman.

The identity of the individual has not been confirmed by police.

A woman and a child in one of the other vehicles that was impacted were transported to Madison Memorial Hospital.

Law enforcement says the pursuit started in Fremont County before entering Madison County.

The Bonneville County Sheriff’s Office is seeking the public’s help in identifying the 2 male suspects in the attached pictures. Both suspects are connected to the theft of a vehicle, use of a financial transaction card, and possibly other crimes.

These pictures were taken from security video at the Ammon Walmart. Also, the stolen vehicle in connection with these two suspects was taken out of Ucon and recovered today in Bannock County.

Rexburg pursuit suspect identified, booked into jail as police seize evidence

IDAHO FALLS — Police have identified the suspect involved in today’s pursuit that ended in Rexburg.

Travis Castro, 30, was booked into the Madison County Jail around 10 p.m. Thursday on two charges, felony eluding and felony possession of a controlled substance.

In addition to the two felonies, Castro is being held on three misdemeanor warrants out of Bonneville County and a felony warrant for grand theft. The felony warrant stemmed from an unrelated Idaho Falls Police theft of a vehicle case from May.

Idaho Falls Police spokeswoman Joelyn Hansen said in a news release that “Castro, of Idaho Falls, has not been arrested for Tuesday morning’s Guns N Gear burglary. But, appropriate charges are pending a prosecutor review.”

Idaho Falls and Rexburg police officers served a search warrant on the white pick‐up truck Castro was driving.

During the search of the vehicle, detectives identified the truck as being stolen from HK Contractors, Inc., in Idaho Falls. It is also believed to be the vehicle captured by surveillance footage from the Guns N Gear burglary, according to an Idaho Falls news release.

Additionally, detectives recovered four guns from the truck which were identified as being stolen from Guns N Gear.

The Guns N Gear burglary is still an active investigation. Detectives, however, do not believe there is anyone else involved.

Six cars were damaged when the crash ended on Main and Center Street, including the truck the suspect was driving. There was also a four-wheeler in the back of the truck.

A woman and a child involved in the crash were transported to Madison Memorial Hospital. Their condition is unknown.

Sugar City man pleads guilty to raping teenager

REXBURG — A Sugar City man admitted to raping a teenage girl as part of a plea agreement in a Madison County courtroom Monday morning.

Jose Nevarrez-Portillo, 20, was originally charged with forcible sexual penetration by a foreign object and forcible rape for an incident that occurred March 31.

Court documents show a 16-year-old girl and a teenage friend met up with Nevarrez-Portillo and Thor Ware Jr., 20, at Harris Trailer Court on Third South in Sugar City. Ware and Nevarrez-Portillo allegedly forced the girls to have sexual intercourse with them.

As part of the agreement the forcible penetration charge was dropped and forcible rape charge downgraded to statutory rape. Additionally Nevarrez-Portillo agreed to testify against Ware, who is also facing a felony rape charge.

Nevarrez-Portillo told Judge Gregory Moeller he did not know the girl was underage when he had sex with her.

Nevarrez-Portillo was ordered to undergo a pre-sentence investigation along with psychosexual evaluation before he is sentenced.

Madison County Prosecutor Sid Brown will recommend Moeller retain jurisdiction if Nevarrez-Portillo is to testify truthfully against Thor Ware. However, the deal is not binding on the judge, who will have the discretion to sentence the defendant up to life in prison.

Nevarrez-Portillo is scheduled to be sentenced Nov. 7.
